If you're like most people, you dream about owning a nice home in a nice neighborhood, well here's your chance to make your dreams come true.
The term "subject to" is when a buyer takes the deed to a property “subject to” the existing mortgage/loan. The unpaid balance of the existing mortgage is then calculated as part of the buyer’s purchase price. The loan stays in the seller's name, but the buyer gets the deed and therefore controls the property. The buyer makes the mortgage payments until the loan is paid in full or the property is sold and the mortgage is then paid from the proceeds of the sale.
For example:
When a buyer takes title to property "subject to" the loan, the lender is not notified of the transaction or asked for their approval, because the seller is not released from the responsibility of the loan. The buyer is making the payments instead of the seller in this case. The buyer is responsible for all the property taxes, insurance, repairs and all expenses associated with the property. The seller will be asked to provide escrow with their last payment record, which will be used to calculate the exact principal balance at close of escrow.
"Subject-To" Options:
There are some options to consider when selling 'Subject-To'. A subject to sale does not necessarily involve owner financing but it could. Whether you as the seller carries any type of financing or whether you decide to wrap the mortgage, the options will fit your best interest. We will always discuss the options with you so that you can be completely informed in the process.
